Brazil’s socialist President Luiz Inácio Lula da Silva secured a fourth term Sunday after a leftist Supreme Court justice who previously served as his criminal defense attorney ordered a last-minute voting extension, triggering confusion at polling stations and a demand from challenger Flávio Bolsonaro to annul the election.
Justice Cristiano Zanin, whom Lula appointed in 2023, ordered voting extended nationwide by two hours just minutes before polls were scheduled to close.
The intervention came primarily at the request of Lula’s electoral coalition.
With approximately 99.9% of polling sections tabulated, Lula received 51.77% of valid votes, approximately 64.17 million, against Bolsonaro’s 48.23%, approximately 59.79 million, according to results reported by Bloomberg.
The Superior Electoral Court proclaimed Lula the winner.
Roughly three hours after the victory, Bolsonaro said he would not concede and requested annulment over the voting extension.
Bolsonaro, the son of persecuted former President Jair Bolsonaro, was expected to win the election.
Lula-Appointed Justice Intervenes Minutes Before Closing
Zanin ordered polling extended from 5 p.m. to 7 p.m. Brasília time after Lula’s coalition cited reduced bus service and transportation difficulties.
The coalition identified problems in municipalities including Salvador, Feira de Santana, and Lauro de Freitas in Bahia, along with locations in São Paulo and other states.
Bolsonaro’s campaign separately sought extensions limited to municipalities affected by heavy rain, mainly in southern and southeastern Brazil.
But Zanin’s nationwide order reached many polling locations after they had already closed.
Electronic voting machines that had produced their final reports could not be reopened.
Poll workers reported conflicting instructions, leaving some stations open while others remained shut.
The intervention placed a justice with direct professional ties to Lula at the center of a consequential election-day decision sought by the president’s coalition.
Election Chief Calls Extension Unprecedented
The Superior Electoral Court briefly paused tabulation after an early partial count.
Zanin subsequently clarified that the extension applied only to polling sections whose machines had not yet closed.
Votes from closed machines would be counted normally.
Electoral Court President Kassio Nunes Marques issued corresponding instructions, directing regional courts to keep only still-open sections operating until 7 p.m.
Nunes Marques described the extension as “not a conventional decision. Everything was unusual,” noting that the court had never previously overseen such a nationwide extension.
He acknowledged operational difficulties but said technical measures allowed counting to proceed without compromising the overall process.
The clarification nevertheless left a disparity: some locations could continue accepting voters while stations with closed machines could not reopen.
Bolsonaro Reverses First-Round Lead
Lula’s victory marked a dramatic turnaround from the October 4 opening round, when Bolsonaro led approximately 47% to 45%, a difference of about 2.2 million votes.
No candidate since Brazil restored direct presidential elections in 1989 had finished second in the first round and then won the runoff.
Pre-runoff surveys showed a tight contest, with some placing the candidates near parity or Bolsonaro slightly ahead among valid votes.
Lula ultimately won by approximately 4.38 million votes.
Abstention fell from roughly 21% in the opening round to about 19% in the runoff.
Annulment Fight Would Require Evidence of Electoral Impact
Electoral law professor Fernando Neisser of Fundação Getulio Vargas said annulment could become possible in a sufficiently narrow race if evidence showed that extended voting disproportionately benefited areas favoring one candidate.
He pointed to the unequal circumstances created when the order arrived after some machines had closed while other stations remained open.
Brazilian law permits annulment and a new election when irregularities compromise legitimacy or could change the candidates’ ranking.
Such action generally requires evidence of a material impact.
The voting extension alone does not establish that Lula’s victory was fraudulent or that the result would have changed without it.
But Bolsonaro’s refusal to concede sets up a challenge centered on an extraordinary intervention: Lula’s former defense attorney expanded voting hours at his coalition’s request, after some polling stations had already shut their doors.
