Unelected European Union bureaucrats are tightening their grip on American technology platforms, ordering ChatGPT, Reddit, and Roblox to comply with the bloc’s sweeping online speech regulations or risk crippling financial penalties.

The European Commission has officially designated ChatGPT as a “Very Large Online Search Engine” (VLOSE) under the EU’s controversial Digital Services Act (DSA).

Reddit and Roblox have meanwhile been classified as “Very Large Online Platforms” (VLOPs).

The designations place all three American services under the DSA’s most stringent regulatory regime.

The companies now have until January 2027 to comply with additional requirements governing how they assess, monitor, and mitigate what EU regulators classify as “systemic risks.”

Those requirements extend beyond material that is actually illegal.

Under the DSA, regulators can also scrutinize lawful information they determine contributes to broader “systemic risks,” including content deemed “misleading,” “deceptive,” or “disinformation.”

That sweeping authority has fueled warnings that Brussels has created a censorship mechanism capable of pressuring American companies to suppress perfectly legal speech.

EU Extends Its Reach Over American Platforms

The European Commission triggered the heightened restrictions based on the enormous number of Europeans using the three services.

ChatGPT reported 159.1 million average monthly active users in the EU.

Reddit reported 57.2 million, while Roblox reported 46.6 million.

Each exceeds the DSA threshold of 45 million users.

Their new status subjects them to requirements including annual systemic-risk assessments, measures designed to mitigate those risks, and independent audits.

The platforms can also be forced to provide data to the European Commission, authorities in EU member states, and approved researchers investigating supposed systemic risks.

For critics of the DSA, however, the most alarming provisions concern what regulators can demand from companies over speech that breaks no law.

Lawful Speech Caught in Brussels’ ‘Systemic Risk’ Dragnet

The DSA requires companies to assess risks associated with the spread of illegal content.

But Brussels did not stop there.

The legislation explicitly directs providers to examine information that is not illegal but nevertheless supposedly contributes to an identified “systemic risk.”

Companies are instructed to consider how their platforms disseminate or amplify “misleading or deceptive content, including disinformation.”

That distinction is critical.

The EU’s regulatory machinery therefore reaches beyond enforcing laws against illegal material and into determining how platforms handle lawful speech that bureaucrats believe poses a broader societal risk.

Once regulators classify certain information as contributing to a “systemic risk,” platforms can face pressure to change how that material is recommended, amplified, moderated, or distributed.

And the meaning of “systemic risk” is extraordinarily broad.

That gives Brussels enormous leverage over the rules governing what millions of people can see and say online.

Devastating Fines Hang Over Companies

The DSA backs its requirements with enormous financial penalties.

Companies found violating the law can face fines of up to 6% of their worldwide annual turnover.

For some of the world’s largest technology companies, that potentially means billions of dollars.

The financial threat gives EU regulators extraordinary leverage over American companies operating inside the bloc.

Rather than simply regulating illegal activity within Europe, Brussels has constructed a system capable of influencing the moderation policies and algorithms of major global platforms.

And because the same platforms operate internationally, critics have long warned that Europe’s censorship demands could ultimately affect users far beyond the EU’s borders.

American Platforms Face January Deadline

ChatGPT, Reddit, and Roblox now have until January 2027 to satisfy the additional obligations imposed by their new classifications.

That means documenting supposed systemic risks, demonstrating measures to mitigate them, submitting to independent scrutiny, and opening more of their internal data to regulators and approved researchers.

The latest designations bring three more enormously popular American services under the strongest provisions of Europe’s online regulatory regime.

And the fundamental issue reaches far beyond the three companies involved.

Brussels has given unelected officials the power to pressure online platforms not merely over illegal material, but over lawful speech bureaucrats decide is “misleading,” “deceptive,” or otherwise dangerous.
