Dr. Anthony Fauci’s longtime senior advisor has pleaded guilty in federal court after admitting to participating in a conspiracy to conceal government records while working to restore taxpayer funding for EcoHealth Alliance and undermine the theory that COVID-19 leaked from a Chinese laboratory.
Dr. David Morens, who served for years as a senior advisor to Fauci at the National Institute of Allergy and Infectious Diseases (NIAID), entered a guilty plea Tuesday in U.S. District Court in Greenbelt, Maryland, to conspiracy to commit offenses against and defraud the United States.
The plea follows years of revelations stemming from Morens’ own emails, in which he openly discussed using private Gmail accounts to evade Freedom of Information Act (FOIA) requests and make government communications “disappear.”
DOJ Says Morens Worked to Restore EcoHealth Funding
According to the Justice Department, the conspiracy began after the NIH terminated EcoHealth Alliance’s grant, “Understanding the Risk of Bat Coronavirus Emergence.”
The grant had routed U.S. taxpayer money through EcoHealth Alliance to the Wuhan Institute of Virology before being canceled in 2020 amid growing scrutiny over COVID-19’s origins.
Prosecutors say Morens and his co-conspirators agreed to help EcoHealth recover the canceled funding while working to “counter the narrative that COVID-19 leaked from a lab.”
Under Tuesday’s plea agreement, Morens admitted the conspiracy lasted from approximately April 2020 through at least June 2023.
In exchange for his guilty plea, prosecutors agreed to dismiss the remaining charges contained in a five-count federal indictment, including destruction and concealment of federal records and falsification of documents during a federal investigation.
Those charges each carried potential prison sentences of up to 20 years.
Morens now faces up to five years in prison, three years of supervised release, and a fine of up to $250,000.
U.S. District Judge Paula Xinis scheduled sentencing for Nov. 12.
Secret Gmail Used to Evade FOIA
Court filings show Morens and his co-conspirators deliberately agreed to move official government business onto his personal Gmail account rather than his NIH email account because they anticipated the communications would eventually become subject to FOIA requests.
According to the plea agreement, Morens used the private email account to exchange non-public NIH information, discuss strategies for restoring EcoHealth Alliance’s funding, edit draft letters supporting the nonprofit, and relay back-channel communications concerning senior NIAID leadership.
The government states those communications constituted official federal records that legally belonged on government systems.
Wine, Favors, and ‘Behind-the-Scenes Shenanigans’
The plea agreement also details Morens’ discussions regarding illegal gratuities.
According to prosecutors, an EcoHealth associate sent two bottles of wine to Morens’ Maryland home in June 2020 as thanks for his “behind-the-scenes shenanigans.”
Morens responded by identifying an official act he could perform in return.
According to the DOJ, he proposed writing a scientific commentary supporting the claim that COVID-19 originated naturally rather than leaking from a laboratory.
The co-conspirator later suggested additional rewards, including meals at Michelin-starred restaurants in Paris, New York, and Washington, D.C.
Emails Show Plan to Make Records ‘Disappear’
Much of the government’s case traces back to emails uncovered by the House Select Subcommittee on the Coronavirus Pandemic.
Those messages showed Morens openly describing how he avoided public records laws.
“As you know, I try to always communicate on gmail because my NIH email is FOIA’d constantly,” Morens wrote.
In another email, he added:
“I delete anything I don’t want to see in the New York Times.”
In February 2021, Morens described learning techniques from an NIH FOIA official.
“I learned from our foia lady here how to make emails disappear after i am foia’d but before the search starts, so I think we are all safe.
“Plus I deleted most of those earlier emails after sending them to Gmail.”
Months later he wrote:
“I have retained very few emails or documents on these matters.”
Emails Also Mentioned Fauci’s Private Gmail
One email also referenced Fauci directly.
“There is no worry about FOIAs,” he wrote.
“I can either send stuff to Tony [Fauci] on his private gmail, or hand it to him at work or at his house.
“He is too smart to let colleagues send him stuff that could cause trouble.”
Fauci later testified before Congress that Morens did not advise him on institute policy and said he was unaware of Morens’ email practices.
Fauci also denied using personal email for official government business, although he acknowledged Morens’ actions violated NIH policy.
Investigation Continues to Expand
Morens’ emails prompted Sen. Rand Paul (R-KY) to request a criminal investigation in 2024.
Following Morens’ indictment earlier this year, then-Acting Attorney General Todd Blanche accused him and his co-conspirators of deliberately concealing records to suppress competing theories regarding COVID-19’s origins.
Tuesday’s guilty plea comes as congressional scrutiny of Fauci continues to intensify.
A Senate committee recently voted to hold Fauci in contempt of Congress after he repeatedly invoked the Fifth Amendment during testimony about his role in the government’s pandemic response.
Although former President Joe Biden issued Fauci a sweeping pardon covering conduct between Jan. 1, 2014, and Jan. 19, 2025, lawmakers continue investigating what they describe as a coordinated effort by government officials to conceal records, suppress debate over COVID-19’s origins, and shield key decisions from public scrutiny.
