Tulsi Gabbard Sends Criminal Referrals to DOJ for ‘Deep State Actors’ Behind Trump Impeachment

The Office of the Director of National Intelligence has formally referred the “whistleblower” at the center of President Donald Trump’s 2019 impeachment and the inspector general who advanced the complaint for potential criminal prosecution, marking a significant new development in the years-long fallout from the battle.

The referral, sent to the Department of Justice (DOJ), signals that intelligence officials believe the actions surrounding the original complaint may have crossed legal lines.

Director of National Intelligence Tulsi Gabbard referred the Democrats’ 2019 Trump impeachment “whistleblower” Eric Ciaramella and former Intelligence Community Inspector General Michael Atkinson to the Justice Department for potential criminal investigation.

Criminal Referrals Target Whistleblower, Inspector General

In the referral, ODNI’s general counsel wrote:

“I want to refer information that may constitute possible criminal activity in violation of federal criminal law committed by one or more former employees of the intelligence community.”

The filing specifically cites briefings involving Atkinson, who played a central role in advancing the complaint to Congress.

According to an intelligence official, the referral is directed at Atkinson and Ciaramella.

Ciaramella was the Democrats’ “whistleblower” whose complaint about President Trump’s July 2019 phone call with Ukrainian President Volodymyr Zelensky helped trigger impeachment proceedings.

Gabbard: ‘Deep State Actors’ Drove Impeachment Narrative

Director of National Intelligence Tulsi Gabbard released newly declassified documents earlier this week that she says expose a coordinated effort within the intelligence community.

In a post on X, Gabbard wrote:

Newly-declassified records expose how deep state actors within the Intelligence Community concocted a false narrative that Congress used to usurp the will of the American people and impeach duly-elected President @realDonaldTrump in 2019.”

The documents include transcripts of Atkinson’s closed-door testimony before the House Intelligence Committee, which had not previously been shared with the House Judiciary Committee during the impeachment process.

House Intelligence Committee Chairman Rick Crawford (R-AR) led the effort to release those materials.

Questions Over ‘Urgent Concern’ Determination

According to ODNI, the newly released records show that Atkinson moved forward with the complaint despite concerns about its credibility and scope.

Officials said Atkinson “failed to conduct basic due diligence and willfully exceeded his statutory jurisdiction” by classifying the complaint as an “urgent concern” for Congress.

During his review, Atkinson determined the whistleblower showed signs of “political bias” and was “in favor of a rival political candidate,” but still advanced the complaint.

The whistleblower’s own filing acknowledged reliance on secondhand information:

“I was not a direct witness to most of the events described.”

The Phone Call That Sparked Impeachment

The complaint centered on President Trump’s July 2019 call with Zelensky.

During the call, Trump noted the suspicious business dealings involving former Vice President Joe Biden and his son Hunter.

At the time, Hunter Biden had a paid position on the board of Burisma Holdings while Joe Biden was overseeing U.S. policy toward Ukraine.

Hunter Biden was paid tens of thousands of dollars a month to sit on Burisma’s board, despite having no experience in the industry.

Joe Biden later described his role in pressuring Ukraine to remove prosecutor Viktor Shokin, who was investigating Burisma at the time.

Biden gloated that he withheld a billion dollars in aid money from Ukraine and refused to release it until Shokin was fired.

“I said, ‘You’re not getting the billion.’ … I looked at them and said, ‘I’m leaving in six hours. If the prosecutor is not fired, you’re not getting the money,’” Biden said during a 2018 Council on Foreign Relations event.

“Well, son of a b—-, he got fired,” he added.

Trump and Republicans have long argued that pressure to fire Shokin was part of the Biden family’s lucrative influence peddling operation.

As such, it was widely considered to be justified that Trump would discuss the matter with Zelensky.

However, Democrats argued that Trump’s call with Zelensky constituted a quid pro quo tied to U.S. military aid.

The Trump administration denied wrongdoing.

Renewed Scrutiny of Schiff Contact

Republicans at the time also raised concerns that the “whistleblower” had contact with staff for then-House Intelligence Committee Chairman Adam Schiff (D-CA) before filing the complaint.

Schiff downplayed those interactions during the impeachment process.

Long-Running Dispute Reignited

President Trump was impeached by the House in December 2019 and acquitted by the Senate in February 2020.

House Republicans previously attempted to refer Atkinson and Ciaramella for investigation, but those efforts did not move forward at the time.

With the new criminal referrals now in the hands of the Justice Department, the controversy surrounding the origins of the impeachment inquiry is once again under federal scrutiny.
